Terms of Service

These Terms govern your use of ZaikaQR — the digital menu, QR ordering, and restaurant operations platform operated by Dhruvdev Patel (sole proprietor) from Ahmedabad, Gujarat, India.

#1. Who we are

ZaikaQR ("we", "us", "our") is a software-as-a-service product operated by Dhruvdev Patel (sole proprietorship), with operations in Ahmedabad, Gujarat, India. We provide a digital menu, QR ordering, payments, kitchen-order printing, floor-map management, and operational analytics platform for restaurants and cafés.

#2. Acceptance of these Terms

By creating an owner account, accessing the customer menu through a QR code we generated, or using any feature of our platform, you agree to these Terms. If you do not agree, do not use the service.

If you accept these Terms on behalf of a business, you represent that you have the authority to bind that business to these Terms.

#3. Who can use the service

  • You must be at least 18 years old.
  • Restaurant accounts must be operated by a legal business in India with valid GST or proprietor identity.
  • You must provide accurate, current, and complete information during signup.
  • Customer end-users do not create accounts — they simply scan and order.

#4. Your account & responsibility

  • You are responsible for all activity under your owner credentials.
  • Keep your password confidential — do not share owner login IDs with staff.
  • Notify us immediately at sales@zaikaqr.com if you suspect unauthorized access.
  • You are responsible for the accuracy of menu items, prices, GST settings, allergen info, and operating hours displayed to your customers.

#5. Subscription plans & billing

We offer monthly and annual subscription plans (Starter, Pro, Royal). The features and prices on each plan are displayed on the pricing page and may be updated with 30 days' notice.

  • Plans renew automatically at the end of each billing cycle unless cancelled.
  • Payment is collected via Razorpay or direct UPI in advance for each cycle.
  • Taxes (GST at the prevailing rate) are added at checkout where applicable.
  • Failed payments may result in feature downgrades or account suspension after a grace period.

#6. Payments collected by you from your customers

We are not a payment aggregator
When a customer pays via UPI directly to your bank account, money goes to you. ZaikaQR does not hold customer funds and does not take a commission on customer transactions.

You are responsible for issuing receipts, reporting income, and complying with tax law on the amounts you collect from your customers.

#7. Acceptable use

  • Do not use the platform for illegal goods, fraud, or deceptive pricing.
  • Do not upload menu content that infringes copyright, trademarks, or third-party rights.
  • Do not attempt to reverse-engineer, scrape, or overload our servers.
  • Do not impersonate another restaurant, brand, or person.
  • Do not use the platform to send spam to your customers.

#8. Intellectual property

We retain all rights to the ZaikaQR platform, software, design, brand, and documentation. You retain ownership of your restaurant content (logo, menu items, photos, prices). You grant us a non-exclusive, worldwide, royalty-free licence to display your content on our platform solely to deliver the service to you and to your customers.

#9. Service availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. We may pause, restart, or upgrade systems for maintenance with reasonable notice when possible. We are not liable for downtime caused by Supabase, Vercel, Razorpay, your hosting choice, or other third-party providers we rely on.

#10. Data & privacy

Use of the platform is also governed by our Privacy Policy. You are the data controller for the customer data your menu collects (name, phone, order history). We are the processor and will only act on your instructions.

#11. Termination

You may cancel your subscription anytime from the owner dashboard. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the service in a way that creates legal risk for us or other users. On termination, your data may be retained for up to 90 days for backup and legal compliance, then deleted.

#12. Disclaimers

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — including merchantability, fitness for a particular purpose, and non-infringement.

#13. Limitation of liability

To the maximum extent permitted by Indian law, our total liability to you for any claim arising out of or relating to these Terms or the service is limited to the amount you paid us in the 3 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages (lost profits, lost data, business interruption).

#14. Indemnity

You agree to indemnify and hold us harmless from any claim by your customers or third parties arising out of your menu content, your pricing, your service quality, your tax compliance, or your misuse of the platform.

#15. Changes to these Terms

We may update these Terms from time to time. The "last updated" date at the top reflects the latest revision. Material changes will be notified via email or in-product banner at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

#16. Governing law & dispute resolution

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat. Before initiating litigation, the parties agree to attempt good-faith resolution by direct discussion for at least 30 days.
